Barketing Beacon Terms of Use

Barketing Beacon is a tool that estimates how visible your business is across AI assistants. The results are AI-generated, change over time, and are meant as a directional guide only. They are not a guarantee of visibility, rankings, or business results, and you use them at your own risk. Please read these terms before using the service.

These Terms of Use ("Terms") are an agreement between you and Barketing Solutions Inc. ("Barketing," "we," "us"), the provider of Barketing Beacon ("Beacon," the "Service"). By creating an account, entering an access code, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Beacon does

Beacon queries third-party AI assistants and data sources (including ChatGPT, Google AI, Claude, Perplexity, and related search and listing data) to estimate how, and how often, your business appears in AI-generated answers. It also provides related features such as identity/entity confidence scoring, competitor comparison and monitoring, website traffic insights (where you connect Google Analytics), action plans, and periodic reports. The specific features available depend on your plan.

The Service depends on third-party AI platforms whose outputs are probabilistic and change between runs and over time, and whose behaviour is outside our control. Because of this:

You are solely responsible for how you interpret and act on the information Beacon provides. Beacon is a research and marketing tool, and its output is not professional marketing, legal, financial, or other professional advice. You should not rely on it as the sole basis for any marketing, financial, or operational decision. Barketing is not responsible for decisions you make based on the Service or its data.

4. Your data and privacy

To provide the Service, we collect and store information you give us or connect, which may include: your email address; your business name, website, location, and service area; access codes; scan history and scores; competitor domains you choose to monitor; and, if you connect it, Google Analytics data for your website.

We use this information to run scans, store your history, generate your reports, operate billing, and communicate with you about the Service. To do this we share the minimum necessary information with third-party processors, which currently include: AI and search/listing data providers (to run scans), Stripe (payment processing), Mailgun (email delivery), and Google (Analytics, where you connect it). We do not sell your personal information.

We take reasonable measures to protect your data, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security. 5. Third-party services

Beacon relies on third-party platforms and APIs. Their availability, accuracy, and terms are outside our control, and interruptions or changes to those services may affect the Service. Your use of connected third-party services (for example, Google Analytics or Stripe) is also governed by those providers' own terms.

6. Accounts and access codes

You are responsible for keeping your access code confidential and for all activity under your account. Provide accurate information, use the Service only for a business you are authorized to represent, and do not enter other parties' personal information unlawfully. Do not misuse the Service, including by attempting to scrape, overload, reverse-engineer, resell, or circumvent usage limits.

To the fullest extent permitted by law, Barketing and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 3 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

9. Changes and termination

We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms. We may suspend or terminate access that violates these Terms or that we reasonably believe is harmful to the Service or others.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
